Service Animals

2010 The ADA now defines a service animal as:

Service animal means any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability. Other species of animals, whether wild or domestic, trained or untrained, are not service animals for the purposes of this definition. The work or tasks performed by a service animal must be directly related to the handler´s disability. Examples of work or tasks include, but are not limited to, assisting individuals who are blind or have low vision with navigation and other tasks, alerting individuals who are deaf or hard of hearing to the presence of people or sounds, providing non-violent protection or rescue work, pulling a wheelchair, assisting an individual during a seizure, alerting individuals to the presence of allergens, retrieving items such as medicine or the telephone, providing physical support and assistance with balance and stability to individuals with mobility disabilities, and helping persons with psychiatric and neurological disabilities by preventing or interrupting impulsive or destructive behaviors.

The crime deterrent effects of an animal´s presence and the provision of emotional support, well-being, comfort, or companionship do not constitute work or tasks for the purposes of this definition.
Service Dogs have thousands of hours of documented training, ESA's however have little, if any, training and behave much like pets in public. It is a crime, felony fraud, to claim your pet, or ESA, as a Service Dog with ADA rights.

Florida has laws regarding housing and access to public facilities for hearing and sight-impaired people and people with physical disabilities who need service animals. According to state law, people with service animals are guaranteed full and equal accommodations, advantages, facilities and privileges on all common carriers, airplanes, motor vehicles, railroad trains, motor buses, streetcars, boats and other publicconveyances or modes of transportation and at hotels, lodging places, places of public accommodation, amusement or resort, and other places to which the general public is invited, subject only to the conditions and limitations established by law and applicable alike to all persons. Any trainer of a guide, hearing or service dog, while engaged in the training of such dog, has the same rights and privileges with respect to access to public facilities as is provided for deaf, blind, or mobility impaired persons.According to Florida Statute 413.08 (4) (2002), persons using service animals are to be given equal access to all housing accommodations with the exception of rooming in a single family residence.

Emergency Preparations for Your Pet

In the event of an emergency, such as a hurricane, when you need to evacuate, you should also make preparations for your pet. These recommendations come from the Broward County website (link to http://www.broward.org/atrisk/Pages/Default.aspx.).

  • If you have a service animal, make sure it has a collar with identification. Have proof that the animal's vaccinations are up to date and a copy of written instructions for your animal's care. You are responsible for caring for your service animal during your stay in a shelter.

  • Make other arrangements for any pets you may have, as pets other than service animals cannot be accommodated in the shelters.

  • Broward County has one pet-friendly Mass Care shelter at Millennium Middle School in Tamarac. Pre-registration of pets is required and owners are expected to stay with their pets and provide care for them.

  • If you plan to stay in a Special Medical Needs shelter, call the Broward County Human Services Department in advance at 954-357-6385 (TTY 954-357-5608) to make arrangements for the care of your pet.
